CONDITIONS OF SALE
- REGISTRATION: We need to have your name, address, phone number and two forms of matching I.D.'s to issue you a bidding number.
ALL BIDDERS MUST HAVE A BIDDER NUMBER.
You can register and get your bidder number on Friday or Saturday before the start of the auction.
- PREVIEW: You can preview on the Friday preceding the auction from Noon to 5 pm, or Saturday prior to the auction from 9 am to 10:30 am.
- BIDDING: Each bidder MUST HAVE THEIR OWN BIDDER NUMBER prior to bidding, one bid card per customer. The highest bidder on a lot shall be the buyer of the lot. In the event of any dispute between bidders, the Auctioneer shall have the sole and final discretion to determine the successful bidder or to re-offer and resell the article in dispute. The winning bidder assumes full risk and responsibility upon the Auctioneer calling "SOLD". Absentee Bids may be submitted prior to sale with a cash deposit and proper identification.
- RESERVES: The Auctioneer reserves the right to reject any and all bids. On lots where there is a reserve, the Auctioneer reserves the right to "pass" or not sell the item, or bid on behalf of the consignor. THERE WILL BE NO CHECKOUT OF VEHICLES DURING THE SALE.
- NO VEHICLE: You may not remove a vehicle from the sale until paid in full and auction is completed. No transfer of merchandise from one bidder to another, only the winning bidder shall remove the vehicle from the premises.
- FORMS OF PAYMENT: We accept cash, Cashier Check, Mastercard or Visa. All DEPOSITS must be made in CASH. We do not accept PERSONAL OR BUSINESS CHECKS.
- CHECK-OUT: This is done at the end of sale or until 3:30 pm on Saturday. Check-out may also be done on Monday and Tuesday following the auction from 10:30 am to 4:30 pm.
The original Winning Bidder will forfeit any deposit on the vehicle and any rights to the vehicle, if it is not picked up by 5pm on Tuesday following the Saturday auction.
TERMS OF SALE
- ALL VEHICLES shall be sold AS IS with NO GUARANTEES or warranties of any kind. It is the buyer's responsibility to preview each vehicle and determine its condition, originality and contents. Bring a mechanic.
- IN ADDITION to the selling price the bidder shall be responsible for the following:
- $40.00 Document Prep.
- $40.00 Smog Inspections (Unless Exempt).
- Buyer's Fee is an amount charged by the auctioning dealer for conducting the auction sale. If your bid is accepted as the winning bid on any vehicle you will be charged a buyer's fee in addition to the accepted bid price. The buyer's fee that will be added to your accepted bid price will be calculated as follows: (10% of bid price + 10% of smog inspections + 10% of doc. fee + 44.00 vehicle prep).
- Estimated DMV fees plus sales tax.
- License and late fees, if any.
- Buyer is responsible for vehicle insurance. Buyer assumes all liabilities when Auctioneer says "Sold".
- CASH DEPOSITS of $100 or 10% of the bid price, which ever is more.
CONTRACT CANCELLATION OPTION AGREEMENT - AS REQUIRED BY CALIFORNIA VEHICLE CODE 11713.21
Pursuant to California state law, licensed automobile dealers are required to offer all individuals purchasing for personal, family or
household use, a used automobile selling for less than $40,000 (high bid) a contract cancellation option agreement. This agreement will
allow the buyer to return the vehicle without cause, provided the buyer complies with the following provisions.
Provisions for return of vehicle and cancellation of Contract of Sale.
1. The buyer is fully responsible for any loss or damage sustained to the purchased used car under the contract cancellation
option.
2. The buyer must return the vehicle, where it was purchased, at Bizzarro’s on Spring Street, Branch located at 2581 Spring
Street, Redwood City, CA 94063.
3. Buyer understands and agrees that in accordance with California Commercial Code 2328 and previously agreed to Bidder’s
Agreement Provisions, a sale by auction is complete when the auctioneer calls “sold,” or by the fall of the gavel. When so
announced by the auctioneer, the buyer takes title and delivery of a vehicle offered for sale. The buyer must return the vehicle
no later than posted close of business within two days from date of payment in full.
4. There may not be more than 250 additional miles on the odometer from the time of delivery.
5. A written notice exercising the buyer’s right to cancel the purchase must be signed by the buyer and submitted at the time of
return.
6. The buyer must submit all original receipts of the sale and the original Cancellation Option Contract, given to the buyer at time of
purchase must be submitted at time of return.
7. The buyer must pay a specified restocking fee. The option purchase price will be subtracted from this restocking fee; however,
the buyer is responsible for the additional balance.
8. The vehicle must be returned in the same condition, as it was received and free from any additional debt.

WHAT TO EXPECT
- FREE ADMISSION TO AUCTION PREMISES
- The registration fee to obtain a bidder number at each auction is $5.00 (cash only).
- Parents please keep your children with you at all times. When vehicles are moving through please keep your children behind the yellow lines. If we see unattended children or children crossing the yellow lines while vehicles are moving through the auction you may be asked to leave the auction. This is done for everyone's safety.
- If you are bidding on a car and you become the winning bid. When the announcer says SOLD; and you read and sign the deposit slip, you become the legal owner of that vehicle.
- Each bidder must read and sign a buyer's disclosure form before getting a bidder number. Each bidderÊMUST have a BIDDER NUMBER.
GENERAL RULES
- Each person must have his or her own bidder number. Bills of sale, DMV reports of sale, etc. will not be made out to anyone else. Example: Joe buys a car under his bidder number, but Mary is the actual buyer. Mary must have her own bidder number.
- Vehicles may be auctioned out of numerical order during the auction.
- You will see the term "TMU" in the catalog. This means: (TRUE MILES UNKNOWN).
- Sales tax will be collected on all vehicles sold. The sales tax will be based on the entire cost of the car ie: bid price, smog, documentation prep fee, and buyers fee. The tax is based on the county in which you reside.
- If you fail to pick up your vehicle, you will forfeit your deposit. If you wish to register for future auctions, you will be required to leave $500 cash deposit to secure a bid number. This deposit, as well as the additional 10% per vehicle deposit will be carried over until all purchases are paid in full.
- The DMV fees collected on dealer cars does not show on the receipt. They will be added to the total at the time of payment or at the time of paperwork completion.
All vehicles "paid in full" that have expired registration may be picked up by Tuesday by 5:00 p.m.
